Crypto Wash Sale Rule: What US Investors Need to Know in 2026

The Short Answer
The US wash sale rule disallows a loss if you buy a substantially identical stock or security within 30 days before or after selling it at a loss. As of November 2026, the rule in the tax code covers stock and securities, and the IRS treats crypto as property, so direct crypto has generally been outside it. That may change: the House Ways and Means Committee advanced a bill in September 2026 that would apply wash sale rules to crypto. Spot Bitcoin ETFs are securities, so the rule already applies to them.

How the Wash Sale Rule Works
If you sell a security at a loss and buy a substantially identical one within the 61-day window around the sale, the loss is disallowed for now and added to the cost basis of the new position.

How It Applies to Crypto Today
The IRS treats digital assets as property. Because the wash sale rule is written for stock and securities, direct crypto holdings have generally been treated as outside it. That could change with new legislation.
ETFs Are Different
A spot Bitcoin ETF is a security, so selling one at a loss and buying it back within the window can trigger the rule.
Keep Clean Records
Whatever the rule, record every sale, the date, proceeds and cost basis. It makes Form 8949 straightforward and protects you if rules change.
The Bill That Could Change This
On 16 September 2026, the House Ways and Means Committee voted 38 to 5 to advance the Digital Asset Tax Certainty Act (The Block, 16 September 2026). As reported, it would apply wash sale rules to crypto sold after 14 September 2026 and add a separate exemption for small network and transaction fees on disposals after 31 December 2027. The committee version dropped a staking tax change the industry had asked for.
A committee vote is not law. The bill would still need to pass the full House and the Senate and be signed. But the reported effective date sits before the vote itself, which is why our team flags it now: if you harvest a crypto loss and rebuy within 30 days this year, keep records good enough to adjust if the rule ends up applying retroactively. Check the current status with a licensed tax professional before you file.
A Worked Example
Say you bought Bitcoin and it is now worth 30% less than you paid. You sell, realizing a capital loss, and buy the same amount back two days later.
- Under current law for direct crypto: many tax professionals treat the loss as usable, because crypto is property and the rule covers stock and securities.
- If the same trade were in a spot Bitcoin ETF: the loss is disallowed, added to the cost basis of the new shares, and your holding period carries over.
- If the pending bill became law as reported: the direct crypto trade would be treated like the ETF trade.
The economic position is the same in all three cases. Only the tax treatment differs, which is why records matter more than the strategy.
Traps That Catch ETF Holders
Buying in an IRA
Under IRS guidance, selling a security at a loss in a taxable account and buying it back in your IRA within the window can trigger the rule. The loss is disallowed and, because the new shares are in an IRA, it is not added to your basis there. That loss is effectively gone.
Your spouse’s account
Purchases by your spouse can count as yours for wash sale purposes.
Switching between Bitcoin ETFs
Selling one spot Bitcoin ETF at a loss and buying another from a different issuer is a grey area. Both track the same asset, and whether they are substantially identical has not been settled by the IRS. Treat it carefully.
Economic Substance: The Rule Behind the Rule
Even where the wash sale rule does not apply, the tax code has an economic substance doctrine. It allows the IRS to disregard a transaction that changes nothing about your economic position and exists only for a tax benefit. Whether it applies to a quick sell and rebuy of crypto has not been clearly tested, which is one more reason to document a genuine reason for each sale in your plan.
How Form 1099-DA Changes Record-Keeping
From tax year 2025, US brokers report gross proceeds from digital asset sales on Form 1099-DA, and cost basis reporting applies to covered assets acquired from 2026. That means the IRS sees more of your activity than before. If you harvest losses, your own records need to match the broker’s forms, including the date, proceeds, cost basis and which lot you sold. How Our Team Takes Profits
In the Academy module on goal setting and profit taking, the team starts with a question: what does success look like for you? Growing wealth, beating inflation and paying off a mortgage each lead to a different sell plan. The module also covers stablecoins, which are tokens designed to track the US dollar, as a way to lock in gains without leaving crypto entirely.
In our live cohort on building a sell plan, one example the team shares is taking a third of a position off each time it doubles. The analyst who used it was clear that it is not a crystal ball and not better or worse than a quarter or a half; it is a personal choice. What matters is that the rule is written down before prices move.
A Planning Checklist for Tax-Loss Harvesting
- Write the reason for the sale in your plan before you sell, not just the tax benefit.
- Decide in advance whether you will rebuy, and when.
- Do not buy the same ETF in an IRA or a spouse’s account within 30 days.
- Record the lot, date, proceeds and cost basis for every sale.
- Check the status of pending legislation before year end and before you file.
