SMSF Crypto in Australia: The ATO Rules, Setup and Risks (2026)

An SMSF can hold crypto when the trust deed allows it, the investment strategy covers it and the assets sit in the fund’s own name. This guide walks through the ATO rules, the setup steps, the tax settings and the risks trustees carry.

Yes, a self-managed super fund (SMSF) can invest in crypto in Australia. The ATO allows it when three things line up: the fund’s trust deed permits it, the written investment strategy covers it, and the crypto is held in a wallet or exchange account in the fund’s own name, kept separate from the trustees’ personal holdings. As of October 2026, the ATO also expects trustees to keep full transaction records, value the crypto at market value each 30 June, and deal with related parties only on the strict terms the super rules allow. This guide sets out those rules, the setup steps and the tax settings, with links to the ATO pages that hold the detail.

It is general information for SMSF trustees and people weighing an SMSF. It is not personal financial advice, and the rules carry penalties when they are broken, so confirm your own position with an SMSF specialist, a registered tax agent and your approved SMSF auditor.

Key Takeaways

  • An SMSF can hold crypto when the trust deed allows it and the investment strategy covers it, including concentration, liquidity and risk.
  • Crypto must be held in a wallet or account in the fund’s name and kept separate from personal holdings (ATO).
  • An SMSF cannot acquire crypto from a related party, including a member’s personal wallet, because crypto is not a listed security (ATO).
  • Gains are taxed at the fund rate of 15%, with a one-third CGT discount after 12 months and exempt income in retirement phase (ATO).
  • Your auditor needs evidence of ownership, existence and market value at 30 June, so keep records from day one.

Can an SMSF Invest in Crypto?

An SMSF is a private super fund that you run yourself, with up to six members who are usually also the trustees. The trustees choose the investments and carry legal responsibility for following super and tax law. Nothing in the law bans crypto as an SMSF asset. The ATO’s guide, Navigating SMSF crypto assets, treats crypto as a permitted investment that comes with extra compliance work.

Every SMSF investment must also pass the sole purpose test, which means the fund exists to provide retirement benefits to members and not to give anyone a benefit today. The ATO’s page on SMSF investment requirements covers that test along with the other rules every investment has to meet. For crypto, that rules out things like using fund crypto to pay a member’s personal costs, or giving a member or relative any present-day benefit from fund assets.

The ATO Rules for Crypto in an SMSF

The ATO groups its expectations for SMSF crypto into a handful of areas. Each one below links back to the ATO page that sets it out.

1. The trust deed must allow it

The trust deed is the fund’s rulebook. The ATO’s auditor guidance on crypto asks auditors to confirm that the investment is permitted by the deed. Many older deeds use broad wording that already covers crypto, but some do not. Check yours, and if it needs updating, do that before the fund buys anything.

2. The investment strategy must cover it

Every SMSF needs a written investment strategy that trustees review regularly. The ATO’s page on how to create your SMSF investment strategy lists what it must consider: risk and return, diversification, liquidity, the fund’s ability to pay benefits and costs, and whether members need insurance. If one asset makes up a large share of the fund, the strategy should explain why the trustees accept that concentration risk. Record the decision in trustee minutes.

3. Hold it in the fund’s name and keep it separate

The ATO says crypto must be held in a wallet or account registered in the SMSF’s name, separate from the trustees’ and members’ personal assets. An exchange account opened in a trustee’s personal name does not meet that standard, even if the money came from the fund. For self-custody, the trustees need records showing the wallet belongs to the fund and who controls access to it.

4. Related parties and arm’s length dealing

Under the SMSF investment restrictions, a fund generally cannot acquire assets from a related party. The exceptions are narrow, such as listed securities bought at market value. Crypto is not a listed security, so a member cannot transfer coins from a personal wallet into the fund, even at market value. All dealings must be at arm’s length. Income from non-arm’s length dealings is taxed at the top rate rather than the fund rate, according to the ATO’s page on how SMSFs are taxed.

5. Market valuation and audit evidence

SMSF accounts must report assets at market value. The ATO’s auditor guidance says auditors need objective evidence of ownership, existence and market value, such as the closing value on a reputable exchange at 30 June, and that a holding statement on its own may not be enough. For assets held with a custodian or exchange, auditors may ask for an independent controls report where one exists. If ownership or value cannot be verified, the auditor may need to qualify the audit and report a breach.

How to Set Up Crypto in an SMSF: Step by Step

This is the order most trustees follow. Your SMSF administrator or accountant may add steps for your fund.

  1. Read the trust deed and confirm it allows crypto. Update it first if it does not.
  2. Update the written investment strategy to cover crypto, including risk, liquidity, diversification and concentration, and minute the decision.
  3. Open an exchange account in the SMSF’s name. Many Australian exchanges offer SMSF or trust accounts that ask for the deed and trustee identity documents.
  4. Fund the account only from the SMSF’s own bank account, never from a personal account.
  5. Decide on custody. If coins move to self-custody, use a wallet that belongs to the fund and record who holds access and how the recovery phrase is stored.
  6. Export transaction records regularly, keep wallet addresses and trustee minutes, and store the AUD value of every transaction.
  7. Record the market value at 30 June each year from a reputable source and give your auditor the evidence they ask for.

Exchange Account or Self-Custody Wallet for an SMSF?

Both can work. The ATO does not require one or the other, but each creates different evidence for your auditor and different risks for the trustees.

FactorExchange account in the fund’s nameSelf-custody wallet controlled by the trustees
Proof of ownershipAccount registered to the SMSF, with statementsFund records linking the wallet to the SMSF, plus trustee minutes
Main riskExchange failure, account freezes, hacksLost recovery phrase, theft, a single trustee holding all access
Audit evidenceExchange statements and, where available, an independent controls reportWallet addresses, on-chain records and a reputable 30 June valuation
Record keepingExports from the exchange, kept at least every few monthsYour own records of every transfer, fee and wallet address

Whichever you choose, plan for what happens if a trustee dies or loses capacity. The fund needs a documented way to reach its assets.

How Crypto in an SMSF Is Taxed

The fund pays the tax, not the members personally. According to the ATO’s page on how SMSFs are taxed and its CGT discount rules:

SituationTax setting (ATO)
Fund in accumulation phaseAssessable income and net capital gains are taxed at the concessional rate of 15%
Crypto held at least 12 monthsA complying super fund can reduce a capital gain by one third (33.33%)
Assets supporting a retirement phase pensionInvestment income, including capital gains, is generally exempt
Non-arm’s length incomeTaxed at the top rate, not the fund rate

Selling crypto, swapping one coin for another, converting to AUD or spending it are all CGT events, as set out in the ATO’s crypto asset transactions guidance. Moving coins between two wallets that both belong to the fund is not a disposal. Our guide to capital gains tax on crypto when you take profits walks through the same events for individuals.

The Risks SMSF Trustees Should Weigh

ASIC’s Moneysmart site describes most crypto assets as high-risk and volatile, and says you can lose your whole investment. Inside a super fund, those risks sit next to compliance risks.

Scams that target SMSF trustees

ASIC issued a warning about SMSFs and crypto investments after people were urged to move super out of a regulated fund into an SMSF to buy crypto. Be wary of anyone who cold calls, messages or advertises a quick switch. Check the person’s credentials, and get advice from a licensed adviser before moving super.

Theft and lost access

The ATO’s guidance on SMSF crypto warns about stolen passwords, impersonation and lost keys. A wallet that only one trustee can open is a single point of failure.

Liquidity and paying benefits

A fund in or near pension phase must pay minimum pensions in cash. If most of the fund sits in a volatile asset, a fall in value can force sales at a bad time. That is why the investment strategy has to deal with liquidity.

Where a Written Plan Fits

The super rules already ask for a written investment strategy. At Collective Shift we teach the same habit through the 5-step SHIFT Method: you set your plan in writing before buying, filter every coin first, and write a Profit Ladder that sets out in advance when you would take profits. For an SMSF, a written exit plan also helps with liquidity, because it shows how the fund will raise cash for benefits and expenses.

Frequently Asked Questions

Can my SMSF buy crypto in Australia?

Yes. The ATO allows SMSFs to hold crypto when the trust deed permits it, the investment strategy covers it and the crypto is held in the fund’s name, separate from personal assets. The fund must also keep records and value it at market value each 30 June.

Can I transfer my personal crypto into my SMSF?

Generally no. An SMSF cannot acquire assets from a related party unless an exception applies, such as listed securities at market value. Crypto is not a listed security, so the ATO says it cannot be acquired from members or other related parties.

Does my SMSF need its own crypto wallet?

Yes. The ATO expects crypto to sit in a wallet or exchange account in the SMSF’s name and to be kept separate from the trustees’ personal holdings, with records that show the fund owns it.

How is crypto in an SMSF valued?

At market value. The ATO’s auditor guidance points to objective evidence such as the closing value on a reputable exchange at 30 June, and says a holding statement alone may not be enough.

What tax does an SMSF pay on crypto gains?

A complying fund in accumulation phase pays 15% on net capital gains, with a one-third discount on assets held at least 12 months. Income from assets supporting a retirement phase pension is generally exempt.

Does Collective Shift give SMSF advice?

No. We provide crypto research and education, including the SHIFT Method and the Live Crypto Portfolio. For your fund, speak with an SMSF specialist, a registered tax agent and your approved SMSF auditor.
